Hong Kong offshore income will no longer enjoy full tax exemption

In October 2021, the European Union listed Hong Kong on the “grey list” (*) of the "non cooperative tax jurisdictions". In response to the European Union, the Hong Kong government revised the tax regulations to optimize Hong Kong's tax exemption for passive offshore income. The optimized "Foreign Source Income Exemption" system (referred to as "FSIE" system) will officially take effect on January 1, 2023. If an enterprise does not comply with the revised "FSIE" system, its offshore passive income will be deemed as not complying with the offshore exemption system (*) and shall be subject to profit tax.
