Hong Kong offshore income will no longer enjoy full tax exemption

In October 2021, the European Union listed Hong Kong on the “grey list” (*) of the "non cooperative tax jurisdictions". In response to the European Union, the Hong Kong government revised the tax regulations to optimize Hong Kong's tax exemption for passive offshore income. The optimized "Foreign Source Income Exemption" system (referred to as "FSIE" system) will officially take effect on January 1, 2023. If an enterprise does not comply with the revised "FSIE" system, its offshore passive income will be deemed as not complying with the offshore exemption system (*) and shall be subject to profit tax. In 2021, we have been paying close attention to the policy on the adjustment of individual income tax for foreigners' subsidies. If the reform is carried out, the individual income tax burden of foreigners will be greatly adjusted. On the last working day of 2021, the Ministry of Finance announced that it would continue to implement the preferential policies of individual allowance for foreigners. That is, the tax exemption of foreign individual subsidies will continue until December 31, 2023.
